Terms & Conditions For Home Performance Contracting Services under the Mass Save® Program & AVID Energy Solutions
These Terms and Conditions ("Agreement") govern the services provided by AVID Energy Solutions ("Contractor", "we", "our", or "us") to the customer ("Customer", "you", or "your") in connection with the Mass Save® Home Energy Services Program ("Program"). By engaging our services, you agree to the following terms:
1. Program Participation
1.1. The Contractor is an approved Home Performance Contractor under the Mass Save® Program, which is sponsored by Massachusetts Program Sponsors such as Eversource, National Grid, Cape Light Compact, and others.
1.2. Eligibility for Program incentives and services is subject to verification by Program Sponsors or their agents.
1.3. Customer participation is voluntary and contingent upon successful completion of a Home Energy Assessment.
2. Scope of Work
2.1. The Contractor will perform services including, but not limited to:
- Home Energy Assessments;
- Weatherization services (Air Sealing, Insulation, Weatherstripping);
- Installation of energy-saving products (e.g., Thermostats, Lighting);
- Other work eligible under the Mass Save® Program.
2.2. All services will be performed in accordance with Program standards and applicable building codes.
3. Pricing and Incentives
3.1. Project costs are based on a combination of Program-funded incentives and customer co-payments.
3.2. The Customer is responsible for paying any portion of the costs not covered by Mass Save® incentives.
3.3. Incentives and rebates are subject to change at any time and are not guaranteed until work is approved and completed.
The Customer may be eligible for financial incentives or rebates through the Mass Save Program.
These may include:
- No-cost air sealing
- 75%–100% off approved insulation upgrades (up to allowable limits)
- Equipment rebates and 0% interest HEAT Loan eligibility
Important Notes:
- Incentives are subject to funding availability and Program rules.
- Final incentive amounts are determined by the Mass Save Sponsors.
- The Contractor is NOT responsible for incentive denial due to eligibility issues or program changes.
4. Scheduling and Access
- The Customer agrees to provide the Contractor with reasonable access to the property to conduct the assessment and complete approved work.
- The Customer must ensure pets are secured and pathways are clear.
- Any scheduling changes or cancellations require at least 24 hours’ notice.
5. Payment Terms
- The Customer is responsible for payment of any costs not covered by Mass Save incentives.
- A payment schedule will be included in the Work Proposal.
- Invoices are due upon receipt unless otherwise specified.
Unpaid balances may incur late fees or result in work stoppage.
6. Customer Responsibilities
The Customer agrees to:
- Accurately provide household information and utility account numbers.
- Cooperate during the assessment and installation process.
- Maintain installed equipment per manufacturer guidelines.
- Notify the Contractor of any concerns or defects within 30 days of installation
7. Contractor Responsibilities
The Contractor agrees to:
- Conduct a comprehensive Home Energy Assessment.
- Clearly explain recommended improvements and available incentives.
- Provide qualified, insured technicians to complete all work.
- Comply with all applicable building codes, safety regulations, and Mass Save Program standards.
8. Warranty
- Workmanship is typically warrantied for one (1) year from installation unless otherwise stated.
- Manufacturer warranties apply to installed products and equipment.
- This warranty does not cover misuse, neglect, or damages unrelated to the installed measures.
9. Limitation of Liability
To the fullest extent permitted by law:
- The Contractor’s liability is limited to the total amount paid by the Customer under this agreement.
- The Contractor is not responsible for incidental, indirect, or consequential damages arising from participation in the Program.
10. Changes or Cancellations
The Customer may cancel the agreement in writing before work begins. After work begins, cancellation may incur costs for completed work or materials ordered.
The Contractor reserves the right to cancel or postpone work if:
- Unsafe conditions are identified.
- The Customer does not meet program eligibility.
- Access to the property is denied.
11. Dispute Resolution
In the event of a dispute:
- The Customer should first contact the Contractor to resolve the issue.
- If unresolved, the Customer may escalate concerns to the appropriate Mass Save Sponsor or the Massachusetts Department of Energy Resources (DOER).
12. Entire Agreement
This document, along with the Work Proposal and any signed addenda, represents the entire agreement between the Contractor and the Customer for participation in the Mass Save® Home Performance Program.
